Reviewing examples of disability discrimination

On Behalf of | Jan 3, 2022 | Firm News |

In the workplace, you could experience a wide variety of rights violations, whether you experience unlawful harassment or wage violations such as denied overtime. It is also important to take a close look at discrimination, which takes many different forms. Sometimes, people experience unlawful discrimination because they have a disability.

It is very important to review examples of disability discrimination in order to take action if you experience this firsthand. Unfortunately, some people do not recognize their rights or they worry that if they take action, they will face negative consequences (such as losing their job).

Disability discrimination and reasonable accommodation

The U.S. Equal Employment Opportunity Commission reports that covered employers have to provide reasonable accommodations to disabled workers as well as those applying for a position. If the accommodations create undue hardship as a result of being too costly or difficult to put in place, employers do not have to put certain accommodations in place.

Other examples of disability discrimination

Aside from failing to provide reasonable accommodations, it is also against the law for employers to treat a staff member of job applicant unfairly solely because of their disability, or because they have a history of a certain disability. For example, an employer cannot fire, demote, harass or deny benefits to workers due to their disability. Moreover, employers cannot discriminate against workers because someone in their family, such as a spouse, has a disability.

If you have dealt with disability discrimination at work, you need to carefully go over your options. Make sure that you stand up for your employee rights.
